The Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009 is intended to empower the Department of Health and Human Services to provide oversight for health information technology (health IT) promotion, to include securing information exchange, security, safety, and quality. The regulation was enacted with the intention of promoting and expanding the adoption of health information technology by eliminating some of the loopholes identified in the Health Information Portability and Accountability Act (HIPAA) of 1996. Generally, HITECH Act application ensures that medical entities comply with HIPAA rules and notify the affected stakeholders in case health IT is compromised. Besides that, it incentivizes medical entities to observe the privacy and security rules (McGonigle & Mastrian, 2018).

HITECH Act has an impact on system implementation by presenting requirements for securing information exchange, security, safety, and quality, and ensuring that the technology complies with HIPAA rules.
